1. Company Information and Scope

1.1 Company Details

These General Terms and Conditions of Sale ("GTC") are issued by:

1.2 Purpose

These GTC apply exclusively to the online sale of Nuchu products through the Website to customers located in the European Union and Monaco. Together with the order form, they constitute the entire contractual agreement between NuChu ("the Company", "we", "us") and the customer ("you", "Customer").

1.3 Applicability

These GTC apply to:

• Sales to non-professional buyers acting for purposes outside their commercial, industrial, craft, liberal or agricultural activity, in accordance with article L221-1 of the French Consumer Code; and

• Sales to professionals where the transaction falls outside the scope of their main activity and the number of employees is five or fewer, in accordance with article L221-3 of the French Consumer Code.

 

By placing an order on the Website, the Customer acknowledges having read and accepted these GTC in full.

1.4 Minimum Age

The purchase of products by a minor requires the express consent of a parent or legal guardian.

1.5 Availability and Updates

These GTC are permanently available on the Website and will be sent to you by email or post on request. We reserve the right to modify these GTC at any time. The GTC applicable to any order are those in force on the date the order is placed. Customers will be informed of any material changes.

1.6 Severability

If any clause of these GTC is found to be null or unenforceable, the remaining clauses continue to apply in full. Failure by the Company to enforce any clause does not constitute a waiver of that right.

1.7 Geographic Scope

These GTC govern sales to customers with a delivery address in the European Union or Monaco. If you are resident in a territory where the sale or use of these products is wholly or partly restricted or prohibited, it is your responsibility not to purchase from this Website. The Company accepts no liability for consequences arising from a customer's decision to purchase from a territory where such restrictions apply.

 

2. Product Warnings and Advice

2.1 Usage Guidance

Usage instructions and precautions for each product are displayed on the Website. Customers are advised to read and follow these instructions carefully.

2.2 Nature of Food Supplements

The products are food supplements. They are not medicines and are not intended to diagnose, treat, cure or prevent any medical condition. Food supplements should be taken as part of a varied and balanced diet and a healthy lifestyle. They must not be used as a substitute for a balanced diet or medication.

The effects of a course of food supplements are individual and cannot be determined with certainty in advance. The Company does not guarantee specific results.

If you have any doubts about your health, existing medical conditions, or possible contraindications with product ingredients, please consult a doctor before purchasing.

 

3. Orders

3.1 Placing an Order

To place an order, select your chosen products and complete the checkout process. You will be required to provide:

• Full name

• Email address

• Complete delivery address

• Telephone number

• Payment details

 

In accordance with article L.221-14 of the French Consumer Code, the order summary will clearly display the products, total price, and the wording "order with obligation of payment" before you confirm.

3.2 Order Confirmation

The contract is formed when you click the confirmation button and receive an order confirmation email. This email constitutes our acceptance of your order and includes a summary of the products ordered.

3.3 Customer Responsibility

You are responsible for the accuracy of all information entered during checkout, particularly the delivery address. The Company is not liable for delays or failed deliveries resulting from customer data entry errors. Any re-shipment costs arising from such errors will be charged to the customer.

3.4 Right to Refuse

The Company reserves the right to decline an order in cases of non-payment of a previous order or refusal of bank authorisation.

 

4. Subscriptions

4.1 Subscribing

Subscription options are available at checkout. By selecting a subscription, you authorise the Company to charge your payment method on a recurring basis at the interval you select. Subscription pricing is clearly displayed before you confirm.

4.2 Cancellation

Subscriptions are non-binding and may be cancelled at any time by emailing support@mynuchu.com. To avoid a charge for the next billing period, cancellation must be received at least 3 days before the next renewal date (excluding weekends and public holidays).

Orders already processed and dispatched during any notice period will not be refunded, including where the customer unilaterally decides to return the products received.

In accordance with article L.221-18 of the French Consumer Code, for subscriptions involving regular deliveries, the 14-day withdrawal period runs from receipt of the first delivery only.

 

5. Pricing

5.1 Prices

In accordance with article L.113-13 of the French Consumer Code, all prices on the Website are displayed in euros inclusive of all applicable taxes. Delivery costs are shown separately at checkout before you confirm your order.

The price applicable to any order is the price shown on the Website at the time the order is placed. We may change prices at any time, but changes will not affect orders already placed.

Where a promotional price is advertised, it applies to orders placed during the promotional period only.

5.2 Invoicing

An invoice will be issued and sent to you by email after your order is placed. You may also request invoices by emailing support@mynuchu.com.

 

6. Payment

6.1 Terms

Payment is due in full at the time of ordering. We will not process or dispatch your order until payment has been received. Accepted payment methods are displayed at checkout.

6.2 Security

All payment card data is encrypted. Card details are never transmitted in plain text and are not stored by the Company.

6.3 Non-Payment

The Company reserves the right to suspend or cancel pending orders in the event of failed, partial or reversed payment.

 

7. Delivery

7.1 Delivery Areas

Products can be delivered to Metropolitan France, Monaco, and other EU destinations listed on the Website. If you wish to have products delivered to two different addresses, two separate orders must be placed.

7.2 Delivery Times

For deliveries within Metropolitan France, products are dispatched within 48 hours of order confirmation. Once dispatched, delivery takes between 2 and 5 business days depending on the delivery method selected.

For all other destinations, estimated delivery time is between 2 and 14 business days after dispatch. Carrier details will be provided by email after dispatch.

7.3 Express Delivery

Express delivery options may be available at checkout where feasible. Any additional charge for express delivery will be displayed before you confirm your order.

7.4 Failed Delivery

If a parcel is returned to us due to failed delivery or customer refusal, a re-delivery charge of five euros may apply. Return costs incurred by the carrier may also be charged to the customer.

 

8. Legal Guarantees

8.1 Guarantee of Conformity

The Company is bound by the legal guarantee of conformity set out in articles L.217-4 to L.217-12 of the French Consumer Code and the guarantee relating to hidden defects under articles 1641 to 1648 and 2232 of the French Civil Code.

In summary:

• Products must conform to the contract — matching the description, fit for ordinary purpose, and of the quality a buyer may legitimately expect.

• Claims for lack of conformity must be made within 2 years of delivery.

• Claims for hidden defects must be made within 2 years of discovery of the defect.

 

8.2 Limitation of Liability

The Company has subjected all products to quality controls and testing by partner laboratories prior to sale. The Company shall not be liable for:

• Unsuitability of the products for the customer's individual needs

• Damage resulting from improper use of the products

• Failure by the customer to check their health status or potential allergies before ordering

 

Customer testimonials and before-and-after photographs on the Website reflect individual experiences only. They are not a guarantee of results for any other customer.

 

9. Transfer of Risk and Title

In accordance with article L.261-4 of the French Consumer Code, risk in the products passes to you upon physical receipt of the goods. Title passes to you upon receipt of full payment.

In the event of damage or missing items on delivery, you must note your reservations with the carrier as soon as possible and notify us in writing within 14 days of receipt, providing supporting documentation.

 

10. Right of Withdrawal

10.1 Principle

In accordance with article L.221-18 of the French Consumer Code, you have 14 days from the day after receipt of your products to exercise your right of withdrawal without giving any reason.

For subscriptions involving regular deliveries, the 14-day period runs from receipt of the first delivery only.

The right of withdrawal applies to deliveries within France and the European Union.

10.2 Exercising the Right of Withdrawal

To withdraw, send us a clear written statement by registered letter with acknowledgement of receipt or by email to support@mynuchu.com before the period expires. A withdrawal form is available on the Website. If the final day falls on a Saturday, Sunday or public holiday, the deadline is extended to the following business day.

10.3 Returning Products

Following withdrawal, products must be returned complete, in original packaging and in perfect condition within 14 days of notifying us of your decision. You bear the cost of return postage. The right of withdrawal does not apply to products that have been opened, partially consumed, damaged, or whose hygiene seal has been broken.

10.4 Damaged Products on Receipt

If you receive a damaged product, contact us at support@mynuchu.com within 30 days of receipt, providing photographic evidence. In such cases, we will cover return costs and provide a full refund or replacement.

10.5 Refunds

Upon valid withdrawal, we will refund all amounts paid including standard delivery costs (but not premium or express delivery charges) within 14 days of receiving the returned goods or proof of return, whichever is earlier.

10.6 Exceptions

No refund obligation arises in the following cases:

• Quantity of products returned is less than ordered

• Products opened or partially consumed

• Security ring no longer fully intact

• Products or packaging damaged and unfit for resale

• Products not stored in accordance with packaging instructions

 

11. Intellectual Property

All content on the Website, including text, images, logos and product descriptions, is the exclusive property of NuChu and is protected by copyright, trademark and related intellectual property law. Any reproduction or distribution without prior written authorisation is prohibited.

Products remain the property of NuChu until full payment has been received. Non-payment may result in reclamation of goods.

 

12. Personal Data

Personal data collected during your use of the Website is processed in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR) where applicable, and French Law no. 78-17 of 6 January 1978 (as amended).

You have the right to access, rectify or delete your personal data at any time by contacting us at support@mynuchu.com or by post to NuChu, 17 Avenue Albert II, 98000 Monaco.

Your data may be used to process your order, personalise your experience, send newsletters (with your consent), and improve our products and offers. We will share your contact details with delivery carriers solely to fulfil your order. We do not sell your data to third parties.

 

13. Cookies

The Website uses cookies to enhance your browsing experience and to compile visitor statistics. Cookies contain a unique identifier and record your navigation history on the Website. You can configure your browser to decline cookies at any time without affecting your ability to use the Website.

 

14. Miscellaneous

14.1 The data recorded by the Company constitutes proof of all transactions concluded with customers.

14.2 For the purposes of these GTC, "writing" includes postal mail, email and fax.

14.3 If any clause is found null or unenforceable, the remaining clauses continue in full force.

14.4 Failure by the Company to enforce any right under these GTC does not constitute a waiver of that right.

14.5 Force majeure events will suspend the affected party's performance obligations in accordance with applicable law.

14.6 The official language of these GTC is French. In the event of any difficulty of interpretation between the English and French texts, the French text shall prevail.

 

15. Extended Producer Responsibility (EPR)

The Company is registered for Extended Producer Responsibility obligations in France under article L.541-10 of the French Environment Code. Unique identifier issued by ADEME: FR354009_03JDMQ.

 

16. Complaints

Any complaint or query about a product or order should be addressed to:

We will respond within 30 working days. If you are not satisfied, you may send a follow-up by recorded post. In all correspondence, please include your full name, email address, order number and a description of your request. Incomplete requests cannot be processed.

 

17. Disputes and Governing Law

17.1 Mediation

In accordance with the French Consumer Code, in the event of a dispute you may seek resolution through a competent consumer mediation scheme. Before referring a matter to a mediator, you must first submit a written complaint directly to the Company. Mediation requests must be made within one year of the written complaint.

Mediation does not apply to disputes between professionals, matters already before a court, or proceedings brought by the Company against a customer.

17.2 Jurisdiction

If mediation is unsuccessful or inapplicable, disputes arising from these GTC or from any sale shall be referred to the courts of competent jurisdiction under ordinary law.

17.3 Applicable Law

These GTC and all transactions arising from them are governed exclusively by French law.

 

18. Pre-Contractual Information

Prior to placing an order, the Customer has been provided with all information required by the French Consumer Code, including:

• Company identity, address, contact details and VAT number

• Essential characteristics of the products

• Total price inclusive of taxes, and delivery costs

• Estimated delivery timeframe

• Details of the legal guarantee of conformity and guarantee against hidden defects

• Terms of payment, delivery and performance

• Right to refer disputes to a consumer mediator

 

By placing an order, the Customer confirms full and unconditional acceptance of these GTC.
